Terms & Conditions
The rules for using the Tiwala Express app and this website, operated by Tiwala Lending Investor, Inc.
These Terms and Conditions (“Terms”) govern your access to and use of the Tiwala Express mobile application and this website (“App” or “Service”), operated by Tiwala Lending Investor, Inc. (“Company”, “we”, “us”, or “our”). The Company is a lending company registered with the Securities and Exchange Commission of the Philippines under SEC Registration No. 2026070257152-03 and Authority to Operate No. L-26-1120-9.
Tiwala Express is in development and is not yet available to download. These Terms apply to this website now. They will also apply to the App when it is released. Please read them with our Privacy Policy. If you do not agree, do not use the Service.
1. Acceptance
By using this website, or by creating an account or sending an application once the App is available, you confirm that you have read and agreed to these Terms, the Privacy Policy, and any loan agreement, disclosure statement, or promissory note shown to you before a loan is made.
If these Terms conflict with the disclosure statement or loan agreement for a particular loan, that loan document prevails for that loan.
2. Who can apply
To use the lending service when it is available, you must:
- Be a Filipino citizen residing in the Philippines, or otherwise eligible under the law and our policy
- Be of legal age and able to enter a binding contract
- Hold a valid government-issued ID
- Have an active Philippine mobile number and a bank account or e-wallet in your own name
- Meet any extra requirements shown for the product you choose
We may check eligibility and may approve or decline an application, subject to the law. A visit to this website is not an application and is not an approval.
3. Your account
When registration opens, you must give information that is accurate and keep it current. You are responsible for your login and for activity on your account.
- One person, one account. Do not use another person’s identity.
- Tell us at once if you suspect unauthorized use.
- We are not liable for loss caused by a failure to protect your login, except where the law says otherwise.
4. Applications and approval
Sending an application does not guarantee a loan. Each application is subject to identity checks, credit assessment, and risk review. We may ask for more documents.
The Company’s published lending ranges, which the App is being built to reach, are:
- Personal and salary loans: ₱8,000 to ₱120,000
- Business short-term and working capital financing: ₱50,000 to ₱1,000,000
These ranges are not an offer. The amount, term, interest, and fees offered to you, if any, are decided individually and shown to you before you accept. No loan is binding until you have accepted its disclosure statement.
5. Interest, fees, and charges
Under Republic Act No. 3765, the Truth in Lending Act, and applicable SEC rules, the cost of a loan is disclosed before you accept it. That disclosure may include:
- Interest, at the rate shown in your disclosure statement
- A processing or service fee, if any, shown as an amount or a percentage before you accept
- A late-payment charge, if any, as described in Section 7 and in your disclosure statement
There are no hidden charges. The total payable, the payment schedule, and the charges are shown before you confirm. Any early-repayment rule is stated in the loan documents. This website does not quote a rate, because no rate is offered here.
6. Repayment
You agree to repay the loan, including disclosed interest and fees, on or before the dates in your disclosure statement. Payment channels, such as bank transfer, e-wallet, or an accredited partner, will be shown in the App or by the Company.
- You are responsible for paying on time and for having funds available.
- Payments are applied in the order stated in the loan agreement, typically fees, then interest, then principal.
- Keep proof of payment until the loan shows as fully paid.
7. Late payment and default
If an amount is not paid when due, the loan may be past due or in default. Consequences may include:
- A late charge or default interest, if it was disclosed in the loan agreement
- A report of repayment status to a credit bureau, including the Credit Information Corporation, which can affect your credit standing
- Loss of eligibility for a later loan
- Lawful collection under Section 8
Borrow only what you can repay. Late or missed payment can affect your credit and your ability to borrow later.
8. How we collect
Collection follows SEC Memorandum Circular No. 18, Series of 2019 and Republic Act No. 11765. If an amount is overdue:
- We will not contact people in your phone’s contact list to collect
- We will not use threats, harassment, profanity, or abusive or misleading messages
- We will not publicly shame you for a debt
- Only identified, authorized staff will collect, and only at reasonable hours
- You may report abusive collection to the SEC
9. What you must not do
- Give false or misleading information or documents
- Use the Service for anything unlawful, including fraud or money laundering
- Use another person’s identity, ID, or financial account
- Break into, disrupt, or reverse-engineer the App or this website
- Use bots or scrapers to access the Service
A breach may lead to suspension or closure of an account and may have civil or criminal consequences.
10. Privacy
Personal data is handled under Republic Act No. 10173 and our Privacy Policy, which is part of these Terms.
11. Intellectual property
The Tiwala Express name, logo, software, and materials on this website and in the App belong to the Company or its licensors. You receive a limited, non-exclusive, revocable license to use the App for its intended purpose once it is released. You may not copy, modify, sell, or create derivative works without written consent.
12. Disclaimers and liability
The website and, when released, the App are provided “as is” and “as available.” To the extent the law allows, we disclaim warranties of availability, reliability, and fitness for a particular purpose.
To the extent the law allows, the Company is not liable for indirect, incidental, special, or consequential loss, or for loss caused by interruption, delay, or events outside our reasonable control. Nothing here limits liability that Philippine law does not allow us to exclude.
13. Suspension and ending access
We may suspend or end access if you breach these Terms, give false information, or act unlawfully, or if a law or regulator requires it. Ending access does not cancel a repayment you still owe.
You may stop using the Service at any time. Any unpaid balance remains due until it is settled.
14. Law and disputes
These Terms are governed by the laws of the Republic of the Philippines. A dispute is first handled through our complaints process under Republic Act No. 11765.
If it is not resolved, it may go to the proper regulator, including the SEC, or to the courts of Makati City, to the extent the law allows.
15. Changes
We may update these Terms. A material change will be posted on this website and, once the App is live, notified at least seven (7) days before it takes effect. Continued use after that date means you accept the update.
